1.Introduction

These terms and conditions do not affect your statutory rights as a consumer. The consumers statutory rights are not excluded or limited in any way in accordance with the Sale of Goods Act 1979 (as amended).

Recreate Scotland is a Bright Green Environmental Solutions ltd company.This is an Agreement between you (the Member), and Bright Green Environmental Solutions Ltd, a company registered in Scotland (registration number SC561056), whose registered office is at 471 Gilmerton Road, Edinburgh, EH17 7JG.

By completing the joining process at our website and becoming a Member of Recreate Scotland, you are accepting all the terms and conditions in this Membership Agreement. You should only join if you have read them and accept them.

By viewing and / or purchasing from this website www.recreatescotland.com you are entering into a legally binding contract and are deemed to have accepted the following terms and conditions as set out below and in the separate privacy policy. If you do not agree to be legally bound to the terms below or if you have any questions regarding our terms of use please contact our team who will be pleased to assist with your query.

These terms and conditions may be changed at any time and will be posted online. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website.

You accept these Terms of Use by clicking the "Create Account" button when registering a Recreate Scotland account and by otherwise accessing or using the Recreate Scotland websites, services, applications and toolsor as otherwise indicated on a specific site, service, application or tool.

2. Membership

Recreate Scotland is a membership service. You are purchasing access to the website only. Members will not be purchasing any goods listed on the website but instead will be requesting goods from Recreate Scotland. Member must only sign up using the membership category that applies to them. Any attempt to abuse this membership sign up process will result in termination from the site with no refund provided.

2.1 Cancellations and refunds

Subscriptions whereby the member agrees to pay the yearly subscription cost in full are eligible for cancellation with full refund in the first 7 days of membership. Any attempt to claim a refund out with the first 7 days will be rejected. Member can still however request to cancel their membership at any point during the yearly subscription period. Please not that for all subscriptions, the subscription begins at the time of purchase. Refunds will not be given if the member has placed an order for any resources on the website and has received these items.

2.2 Eligibility, suspension and termination

Membership is not an automatic right. Purchasing a subscription does not protect you as a member from having your membership terminated or suspended if you are in violation of any of the rules of the website. We hope you ill be with us for a long time but we may use reasonable discretion to decide whether or not your use of Recreate Scotland complies with these terms. We can suspend or terminate your membership at any time and for any reason (within reason in accordance to our terms and conditions).

2.3 Abusing Recreate Scotland Membership

Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Recreate Scotland if we think that they are creating problems, infringing the rights of third parties or acting inconsistently with the letter or spirit of our policies (including, without limitation, circumventing temporary or permanent suspensions or harassing the Recreate Scotland employees or other users). However, whether we decide to take any of these steps, remove hosted content or keep a user off Recreate Scotland or not, we do not have any obligation to monitor the information transmitted or stored on our sites, services, applications and tools and we do not accept any liability for unauthorized or unlawful content on Recreate Scotland or use by users.

You acknowledge that Recreate Scotland may establish limits concerning use of the Service, including the maximum number of product/resources that members will be able to retain through the service. You acknowledge that Recreate Scotland reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that Recreate Scotland shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

2.4 Solo Membership Plan

2.4.1 Members shall be utilising the service for personal use only.

2.4.2 Only one user will be permitted to use the service for each membership sign up.

2.4.3 Only one address can be allocated to each membership and all goods shall be delivered to that address only.

2.4.4 If signing up on behalf of another, please utilise the details of he or she who shall be receiving the goods/resources.

2.4.5 Delivery for solo members will not be included in the price of the service.

2.4.6 Installation of goods will not be included in the price of the service.

2.4.7 Members must only request resources for personal use. Recreate Scotland reserve the right to cancel any order deemedout with personal use and therefore breeching these terms.

2.5 Non-Profit Membership Plan

2.5.1 The service shall be used by the registered non-profit organisation only.

2.5.2 No persons associated with the member organisation should use the service for their own benefit.

2.5.3 The organisation may utilise multiple delivery addresses or points of use addresses. Resources do not have to be used solely at one point of use.

2.5.4 Resources requested using Recreate Scotland should be used to achieve the objectives of the non-profit member organisation. They should not be requested for resale purposes by the member organisation. Doing so may be cause for termination of membership.

2.5.5 Delivery services may be included for non-profit members. Location limitations apply. See delivery terms for further notice.

2.5.6 Installation services may be included for non-profit members. Location limitations apply. See installation terms for further notice.

2.5.7 Recreate Scotland offers unlimited access and ordering quantities to non-profit members. However due to the community supportive nature of the service and the idea that everybody should benefit equally, orders may be capped at any point by Recreate Scotland and Recreate Scotland reserve the right to cancel any order/request for goods.

2.6 SME Membership Plan

2.6.1 The service shall be used by the registered organisation only.

2.6.2 SME members must have no more than 40 employees.

2.6.3 No persons associated with the member organisation should use the service for their own benefit.

2.6.4 The organisation may utilise multiple delivery addresses or points of use addresses. Resources do not have to be used solely at one point of use.

2.6.5 Resources requested using Recreate Scotland should be used to achieve the objectives of the organisation. They should not be requested for resale purposes by the member organisation. Doing so may be cause for termination of membership.

2.6.6 It is forbidden for any business in the furniture or white goods, fittings or homewares industry or any other industry associated with the sale of any goods similar to the resources listed on Recreate Scotland, to become a member of Recreate Scotland.

2.6.7 Delivery support may be included for SME members. Location limitations apply. See delivery terms for further notice.

2.6.8 Installation support may be provided for SME members. Location limitations apply. See installation terms for further notice.

2.6.9 Recreate Scotland offers unlimited access and ordering quantities to SME members. However due to the community supportive nature of the service and the idea that everybody should benefit equally, orders may be capped at any point by Recreate Scotland and Recreate Scotland reserve the right to cancel any order/request for goods.

2.7 Large Org Membership Plan

2.7.1 The service shall be used by the registered organisation only.

2.7.2 Large Org members will be those organisations that have 41+ employees.

2.7.3 No persons associated with the member organisation should use the service for their own benefit.

2.7.4 The organisation may utilise multiple delivery addresses or points of use addresses. Resources do not have to be used solely at one point of use.

2.7.5 Resources requested using Recreate Scotland should be used to achieve the objectives of the organisation. They should not be requested for resale purposes by the member organisation. Doing so may be cause for termination of membership.

2.7.6 It is forbidden for any business in the furniture or white goods, fittings or homewares industry or any other industry associated with the sale of any goods similar to the resources listed on Recreate Scotland, to become a member of Recreate Scotland.

2.7.7 Delivery support may be included for SME members. Location limitations apply. See delivery terms for further notice.

2.7.8 Installation support may be provided for SME members. Location limitations apply. See installation terms for further notice.

2.7.9 Recreate Scotland offers unlimited access and ordering quantities to SME members. However due to the community supportive nature of the service and the idea that everybody should benefit equally, orders may be capped at any point by Recreate Scotland and Recreate Scotland reserve the right to cancel any order/request for goods.

2.7.10 Access to Recreate Scotland will only be granted once both parties have agreed a membership fee and subsequent fee has been paid.

2.7.11 Membership fees may change depending on the organisations use of the website and the amount of resources requested throughout the membership year.

3. Pricing

The cost of subscription will be made clear to you on the sign-up section of the landing page. Prices vary across different membership structures.Payment can be made using all major credit or debit cards and via PayPal. Where relevant, currency conversion values may fluctuate, and conversion fees may be charged by your bank. By submitting payment details to us, you promise that you are entitled to purchase a subscription using those payment details. Payment can also be made via BACS transfer on request.

Recreate Scotland hold the right to change the pricing of membership at any point. As a yearly subscriber, your purchase price will not be affected. It may differ the following year, but you will not be charged any more or any less depending on the membership cost at any given time.

4. Delivery

4.1 Recreate Scotland and associated logistical partners will deliver all resources to the addresses provided upon subscription. Goods may be collected in circumstances whereby this agreement has been made prior to the member claiming resources from the website.

4.2 Delivery is not included in the membership costs for solo and SME members.

4.3 Delivery will never be included for any membership if the recipient and delivery address are more than 60miles from Edinburgh, EH1.

4.4 Delivery schedule is entirely at the discretion of Recreate Scotland and our logistical partners.

4.5 Non-profit members and Large org members may benefit from free delivery. Terms should be agreed prior to the member claiming resources.

4.6 Recreate Scotland will not take responsibility for non-deliveries.

4.7 In the case of a delivery being refused or aborted in circumstances whereby delivery is included in the membership cost, Recreate Scotland reserve the right to request a delivery fee to cover any delivery overheads for a second delivery attempt.

5. Installation

5.1 Recreate Scotland and associated logistical partners will install any circumstances whereby this agreement has been made prior to the member claiming resources from the website.

5.2 Installation is not included in the membership costs for solo and SME members.

5.3 Installation will never be included for any membership if the recipient and delivery address are more than 60miles from Edinburgh, EH1.

5.4 Non-profit members and Large org members may benefit from free delivery. Terms should be agreed prior to the member claiming resources.

6. Licence

You are permitted to print and download extracts from this Website for your own use on the following basis:

a) No documents or related graphics on this Website are modified in any way;

b) No graphics on this Website are used separately from accompanying text.

6.1 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with that stated above for any purpose is prohibited.If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website. No part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

Any rights not expressly granted in these terms are reserved.

While we endeavour to ensure that this website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period. These terms and conditions can be governed by and constructed in accordance with the laws of Scotland. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Scottish Courts.

12. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found byany court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have fullforce and effect.Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.

We do not store customer credit card details.
